So previously we are focusing on being a Defendant. Now we go to the Plaintiff’s side.

Steps of litigation – Plaintiff

We’ll simply highlight the brief procedures of it without discussing anything deeper because every case is on its fresh scenario and with different outcome and strategies and procedures

  1. Discussion with the other side (may skip if not feasible)
  2. Demand letter
  3. Initiating legal proceedings as a Plaintiff
  4. Writing down your claim in pleadings
  5. Responding to the Defence, if any
  6. Direction hearing before a master of the Court to set out future directions to pave the way of the litigation
  7. Discovery of documents with relevance to your claim
  8. Witness Statements
  9. Expert report (if a field of expert will help the case)
  10. Some complicated small mini proceedings known as “interlocutory proceedings” (if any)
  11. Setting down the case for trial
  12. Trial, where you’ll call your witness and the other side will call theirs, with heavy cross-examination and questioning (usually the case)
  13. And finally knowing the result – the judgment
  14. And more…. appeal…

All of these look simple and has a framework, but the legal and tactical work is important and it is strongly advised to instruct a legal representative throughout the procedures so as not to take any step wrong because sometimes you can’t afford to.
